
Since May of 2024 a small group of Montgomery County Residents have been researching, observing and challenging voter registrations with the Montgomery County Board of elections. Through this process have gained understanding the election process in our county and across the state of Ohio.
Our engagements have included:
Challenging the county registrations of individuals who have moved, registered to vote and voted in other states.
Verified the execution of Secretary of State directives
Observations on how the individual concerns are handled.
During this process we have established a working relationship with the Montgomery County Board of elections board members and hope that relationship continues in the future.
As part of this process our team has assembled a Dossier that contains our findings of concerns we have regarding how voter challenges, Secretary of State Directives and individual concerns are handled. We addressed the Montgomery County Board of Elections on December 13, 2024 with our concerns.
We requested that the Montgomery County Board of Elections provide a written response regarding what action this board will take to resolve these concerns by January 17, 2025.
Concerns
Handling of SoS directives and requirements for eliminating duplicate registrations across counties.
National Change of Address voter challenges regarding voters who are no longer eligible to vote in the state of Ohio.
Unprofessional behavior of the director of the Montgomery County Board of Elections.
Marcel Strbich expressed his concerns regarding Issues with the Montgomery County Board of elections failure to follow the following SOS directives.
James Greenfield presented the following speech at the Montgomery County Board of Elections.
Failure to grant any National Change of Address (NCOA) voter challenges regardless of the evidence presented. Following ORC 3503-02H (Residency Determination) and 3501.11 (board duties)
More than 80 voters were challenged using the prescribed Form 257, Challenge
of Right to vote and Correction of Registration List - Ohio Form 257. Specifically
registered voters who had changed their Residence from Montgomery County
“active registration” list were brought to the Montgomery County Board of Elections attention. These were moved register voters (MRV) who had registered and voted in a state other than Ohio. None of those challenges were accepted for removal from State Wide Voter
Roll (SWVR).
due to failure to include a screen shot of the voter’s date of birth (DOB) from a
<.gov> website. At the September 12 board hearing, all of the challenges were
updated screenshots showing the DOB using a <.gov> website to INCLUDE the
DOB information as requested by the Montgomery County Board of Elections. Instead of accepting the additional information and investigating these issues as specified by Ohio Law the director questioned the use of a government public website to access public voter registrations. These resubmissions included screenshots updated screenshots that matched the stated requirements of the Montgomery County Board of Elections were denied.
In that same September 12th hearing the director questioned the use of a government public records website to request public records. It was also learned that additional evidence was in the possession of the Montgomery County Board of Elections director that was not disclosed in the hearing until a board member specifically asked “whether anyone had picked up the phone at the board of elections and called her and say, hey, do you still live in Florida?”, then it was disclosed that the Montgomery County Board of Elections had verified the challenged voters Florida residency. The board members was then discouraged or dissuaded by the Montgomery County Board of Elections Director consider the fact that he had called and verified the challenged voters Florida Residence status. The board voted 3-0 where board member Eric Blaine was not present to deny this challenge.
In Addition these questionable decisions, hearing notices sent to Challengers
had misleading language regarding the requirements for their presence. The
Notices to Challengers specifically stated “Your presence is not required at the
hearing.” Yet is spite of this clear instruction, at the meeting, it was stated that “...
[since] the failed to show up, their challenges were to be dismissed without any
investigation or consideration.”
In closing, it is request that the MCBOE follow ORC 3501.11(Q) and investigate the residence qualifications of challenged electors.
Unprofessional behavior of the director of the Montgomery County Board of Elections
Scott Taylor presented a speech at the Montgomery County Board of Elections that contained the key elements below.
Today I will be addressing behaviors that I believe creates mis-trust and leads individuals to believe that the Montgomery County Board of Elections is unapproachable. In frustration, those individuals pursue alternative solutions which have the effect of creating more distrust and divert efforts in unprofitable directions.
Examples of recent behaviors include
The Montgomery County Board of Elections director calling Scott Taylor "Disingenuous" at the July 9, 2024, hearing when he expressed concern regarding the directors proposed process for addressing submitted form 257 challenges which was published in the Capital Journal and used to discredit citizens who submitted form 257 challenges across the state of Ohio. This is not acceptable.
Director Appeared more interested in discrediting Dan Blevins instead of investigating the issue of an ES&S tabulator displaying on its display screen that the ballot was rejected. This is not acceptable.
"Mr. Strbich was being coy about the topic and that it was a very convoluted question."
"Mr. Strbich entered and appeared to be very frantic and distressed. Mr. Strbich had lost his phone and was unable to locate it. "This is not acceptable.
Consider this, if Marcell Strbich along with James Greenfield and Jaclynn Shook who submitted affidavits regarding the training perceived that they had a working relationship of trust with the Montgomery County Director, would he not have raised the issue of a missing training slide regarding identifying non citizen IDs to the directors attention instead of taking it to the Ohio supreme court.
